Scope of this Privacy PolicyThis Privacy Policy applies to the KONFAL landing page at konfal.com and to the email waitlist used to provide information about the upcoming KONFAL Kickstarter campaign. The landing page does not currently offer customer accounts, online purchases or payment processing. If we start selling products through this website, we will update this Privacy Policy before doing so.The website is operated from Germany by a German company. We apply the standards of the EU General Data Protection Regulation (GDPR) to all visitors, wherever you are located. Section 17 sets out additional information for residents of the United States.3. Website hosting and technical access dataOur website is hosted by IONOS SE, Elgendorfer Strasse 57, 56410 Montabaur, Germany ("IONOS"). IONOS processes technical data that is required to deliver the website and maintain its security and stability.When you access the website, the following information may be processed:the referring website or source (referrer);
the requested webpage or file;
browser type and browser version;
operating system and device type;
date and time of access; and
the IP address, which IONOS states is anonymised directly upon collection.
The legal basis is Article 6(1)(f) GDPR. Our legitimate interests are the secure, reliable and efficient provision of the website, the prevention of misuse and the investigation of technical errors. According to IONOS, the hosting access data is retained for up to eight weeks and is not transferred to countries outside the European Union in connection with the IONOS web-hosting service.Further information: IONOS information on data processing by web-hosting products (https://www.ionos.de/hilfe/datenschutz/datenverarbeitung-durch-ihr-ionos-produktes/datenverarbeitung-durch-webhosting-produkte/)4. According to IONOS, SiteAnalytics does not use cookies; the analysis is based on log-file information or a pixel, and the IP address is anonymised directly after transmission, so the analysis is not intended to identify individual visitors.The processed information may include the referrer, requested webpage or file, browser type and version, operating system, device type, time of access and an anonymised IP address. The legal basis is Article 6(1)(f) GDPR. KONFAL Kickstarter email waitlist5.1 Purpose and data collected
You can provide your email address to join our early-access waitlist. We use the waitlist to send emails about the upcoming KONFAL Kickstarter campaign, including the launch date, important campaign and product-development updates, progress news and information about exclusive launch offers or discounts.In connection with the registration and confirmation process, the following additional information may be processed:the date and time of registration and confirmation;
the registration source or form used;
IP address and technical data used to operate, secure and document the registration;
subscription and confirmation status;
delivery, bounce, complaint and unsubscribe information; and
technical delivery and error information required to send and administer the emails.
Providing your email address is entirely voluntary. There is no statutory or contractual obligation to provide it. If you do not provide it, you simply will not receive our waitlist emails; you can still use the website without restriction.5.2 Double opt-inWe use a double opt-in procedure. After submitting the signup form, you receive a confirmation email. Your subscription becomes active only after you click the confirmation link in that email. This procedure helps us verify that the email address belongs to the person who entered it and allows us to document the consent given.5.3 Legal basis and withdrawalThe processing of your email address and the sending of campaign-related emails are based on your consent under Article 6(1)(a) GDPR.You may withdraw your consent at any time with effect for the future by clicking the unsubscribe link included in every email or by contacting us at [email protected]. Withdrawing is as easy as giving consent, and it is free of charge. The lawfulness of processing carried out before the withdrawal is not affected.We process registration and confirmation records to demonstrate that consent was obtained and to protect against misuse or legal claims. This processing is based on Article 6(1)(f) GDPR. Our legitimate interests are compliance documentation, fraud prevention and the defence of legal claims.6. Use of Kit for signup and email deliveryWe use the email-marketing service Kit, provided by Kit, Inc., an Idaho corporation in the United States ("Kit"), to manage subscriptions, send confirmation and campaign emails, process unsubscribes and administer technical delivery information.The signup form is hosted on our own website. No content is loaded from Kit when you open the page, and no data is transmitted to Kit until you submit the form. When you submit it, your email address and the technical information described above are transferred to Kit via a programming interface.Kit processes subscriber personal data on our behalf as a processor under Article 28 GDPR. Kit may use subprocessors for services such as hosting, storage, email delivery, security and support. We have limited Kit to the data and functions required for the waitlist and email communications described in this Privacy Policy. We do not use Kit's optional email-open tracking or personalised link-click tracking for this waitlist.Because Kit and some of its subprocessors are located in the United States, personal data may be transferred outside the European Economic Area. Kit is certified under the EU-U.S. Data Privacy Framework. In addition, Kit's Data Processing Addendum incorporates the European Commission's Standard Contractual Clauses where required.Further information: Kit Privacy Policy (https://kit.com/privacy) and Kit Data Processing Addendum (https://kit.com/dpa).7. KickstarterOur emails and our landing page contain links to the crowdfunding platform Kickstarter, operated by Kickstarter, PBC, United States. These are ordinary hyperlinks; no data is transmitted to Kickstarter until you click them. Once you follow such a link, Kickstarter's own privacy policy applies and we have no influence over the processing carried out there.8. Retention of waitlist data
We retain your subscriber data for as long as your subscription remains active. When you unsubscribe or withdraw your consent, we stop using your email address for future campaign emails.After an unsubscribe, limited information may be retained in a suppression record to ensure that you are not contacted again unintentionally. Records required to demonstrate the previous consent may generally be retained for up to three years after the end of the calendar year in which the subscription ended, in line with the standard limitation period, unless a longer or shorter period is required by applicable law or a specific legal dispute. Data that is no longer required is deleted or anonymised.9. Contact by emailIf you contact us by email, we process your email address and the information contained in your message to respond to your request. Depending on the subject of the communication, the legal basis is Article 6(1)(b) GDPR, where the communication relates to a contract or pre-contractual request, or Article 6(1)(f) GDPR, based on our legitimate interest in responding to enquiries and maintaining business communications.We retain correspondence only for as long as necessary for the relevant purpose and any applicable statutory retention or limitation periods.10. Recipients and disclosure of data
We disclose personal data only where necessary for the purposes described in this Privacy Policy. Recipients may include:IONOS SE as the website hosting and analytics service provider;
Kit, Inc. and its authorised subprocessors as the email service provider;
professional advisers or technical service providers where necessary and subject to confidentiality obligations; and
courts, authorities or other public bodies where disclosure is required by law or necessary to establish, exercise or defend legal claims.
We do not sell personal data. We do not share email addresses with third parties for their own independent advertising purposes.11. Cookies and similar technologiesWe do not use cookies or similar technologies that require consent. According to IONOS, SiteAnalytics does not use cookies. Because our signup form is hosted on our own website, the form itself does not set cookies. Kit may use strictly necessary cookies or similar technologies within the confirmation and unsubscribe pages hosted by Kit; these are covered by Section 25(2) of the German TDDDG and do not require consent. We do not use optional email-open tracking or personalised link-click tracking for the waitlist.Any additional non-essential technology will be introduced only after we have obtained your consent where this is legally required. You can also configure your browser to restrict or delete cookies. Blocking strictly necessary technologies may prevent the signup form or confirmation process from working correctly.12. No automated decision-makingWe do not use automated decision-making, including profiling, that produces legal effects concerning you or similarly significantly affects you.13. Your data protection rightsSubject to the requirements of applicable law, you may have the following rights regarding your personal data:the right to obtain information about the personal data we process and a copy of that data (Article 15 GDPR);
